The Board of Township Trustees of the Township of Madison, County of Richland, Ohio, met in regular session at seven (7) o’clock pm on ______November 16, 2009______ at the Township Hall, 817 Expressview Drive, Mansfield, Ohio, with the following members present:

James Boyd

Homer Hutcheson

Mark McDaniel

____Mr. Mark McDaniel____ moved the adoption of the following resolution:

WHEREAS, Ohio Revised Code Section 505.01(A)(2)(b) authorizes the Board of Trustees to donate unneeded, obsolete, or unfit-for-use Township property to an eligible non-profit 501 (c) (3) organization within the state of Ohio if the fair market value of the property is two thousand five hundred dollars ($2,500.00) or less.

AND WHEREAS, the Trustees of Madison Township, Richland County, Ohio require the non-profit organization to 1) provide the Board written notice to include evidence of the organization’s non-profit status and is exempt from federal income taxation pursuant to 26 U.S.C. 501(a) and (c)(3); 2) a description of the organization’s primary purpose; 3) a description of the type or types of property the organization needs; and 4) the name, address, and telephone number of a person designated by the organization’s governing the board to receive donated property and to serve as its agent.

AND WHEREAS, the Trustees of Madison Township will hold a public meeting to consider the request for the donation of unneeded, obsolete, or unfit-for-use Township property and by majority vote will determine if the non-profit organization will meet all criteria for donation.

NOW, THEREFORE BE IT RESOLVED, that the Madison Township Board of Trustees, hereby expresses its intent to dispose of unneeded, obsolete, or unfit-for-use Township property by donation to non-profit 501 (a) and (c)(3) organization.
